submitted by Ian Abovitz, Attorney, Stark & Stark

As we all know, fights and arguments frequently occur at bars and other establishments that serve alcohol. Unfortunately, all too often it is the innocent bystander that is injured in these altercations due to the reckless actions of others.

Fights tend to break out at bars and all too often innocent bystanders are injured due to the reckless actions of those involved.

What should you do if you are minding your own business and suffer a serious injury due to a bar fight? There are several types of legal action that can be taken against the bar where the assault occurred to ensure that you are compensated for your injuries.

First, bars have a responsibility to take extra steps to keep their customers safe, such as hiring security guards and/or bouncers. Failure to take these steps may allow an injured person to obtain a recovery.

Additionally, bars are legally required to stop serving alcohol to visibly intoxicated customers. If the individuals involved in the fight were over-served by the establishment, this may provide an avenue for recovery.

It is vital to understand that the immediate preservation of evidence such as surveillance video, credit card statements, and witness statements is essential to prove this type of case against a bar. This is why you must speak with an experienced personal injury attorney as soon as possible.
